The US tried to get Sudan and Afghanistan to hand him over at times when they knew where he was.

It's a diplomatic issue as to if they had the right to go in and nab him in Pakistan, but not if he should have been nabbed.

As he is not a state actor and able to escape the rule of law in the country he resided in, it is no longer a diplomatic issue - it's a criminal issue, and he was shot while resisting arrest.
